End User License Agreement

This End User License Agreement (“Agreement”) is a binding contract between you (“User”) and 4x8 Construction, Inc. (“4x8”) governing your use of the 4x8 Command Center web application (the “App”).

By creating or accepting an invite to a user account, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

4x8 grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for managing construction projects, estimates, invoices, and related accounting workflows on behalf of 4x8 Construction or contractors authorized by 4x8 (such as AP Construction Builders, Inc.).

2. Permitted Use

• You may use the App to create and manage project records, invoices, estimates, and budgets within the workspace assigned to you.
• You may connect your own Google Gmail and QuickBooks Online accounts for the purpose of supplier-invoice review and accounting synchronization.
• You may invite team members or clients to specific projects through the in-app invite flow.

3. Prohibited Use

You agree not to:

• Use the App to violate any law, regulation, or third-party right.
• Reverse-engineer, copy, modify, or create derivative works of the App.
• Share your account credentials with anyone outside your authorized organization.
• Use the App to send unsolicited bulk email or otherwise abuse connected services.

4. Third-Party Services

The App integrates with third-party services that have their own terms:

• Intuit QuickBooks Online — subject to Intuit’s Terms of Service and Privacy Policy.
• Google Gmail — subject to Google’s Terms of Service.
• Supabase and Netlify — hosting and data storage providers.

4x8 is not responsible for the availability or behavior of these third-party services.

5. Data Ownership

You retain ownership of all project data, invoices, and documents you create or upload. 4x8 retains ownership of the App software, design, and branding.

6. No Warranty

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. 4x8 DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED. YOU USE THE APP AT YOUR OWN RISK.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 4x8 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP. 4x8’S TOTAL LIABILITY SHALL NOT EXCEED $100.

8. Termination

4x8 may suspend or terminate your access to the App at any time, with or without cause. You may stop using the App at any time. Upon termination, your right to use the App ends immediately. Your data may be exported or deleted upon written request.

9. Governing Law

This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in San Diego County, California.

10. Changes to This Agreement

4x8 may update this Agreement from time to time. Continued use of the App after a change constitutes acceptance of the updated Agreement.
